1. Overview

This website is operated by The Fish Room. Throughout the site, the terms “we”, “us” and “our” refer to The Fish Room. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”).

If you do not agree to all the terms and conditions, you may not access the website or use any services.


2. Online Store Terms

By agreeing to these Terms:

  • You confirm that you are at least the age of majority in your jurisdiction.

  • You agree not to use our products for any illegal or unauthorized purpose.

  • You must not transmit any worms, viruses, or destructive code.

  • You agree to provide accurate, current, and complete purchase information.


3. Products & Livestock Disclaimer

3.1 Live Fish, Invertebrates & Plants

We take great care in packaging and shipping live aquatic livestock. However:

  • Livestock health after delivery depends heavily on proper acclimation and tank conditions.

  • It is the customer’s responsibility to ensure proper water parameters before purchase.

  • We are not responsible for losses caused by poor water quality, incompatible tank mates, or improper care.

By purchasing live animals, you confirm that:

  • You understand the species requirements.

  • Your aquarium is appropriately cycled.

  • You accept responsibility for their ongoing care.


4. DOA (Dead on Arrival) Policy

For livestock purchases:

  • Claims must be submitted within 1 hour of delivery.

  • Clear photos AND video evidence in unopened packaging must be provided.

  • Shipping delays caused by courier services may void DOA guarantees.

  • Refunds or store credits are issued at our discretion.

We do not refund shipping costs unless otherwise stated.


5. Shipping & Risk

  • Risk transfers to the customer once the order is handed to the courier.

  • We are not liable for courier delays, weather events, or incorrect shipping addresses provided by the customer.

  • Customers are responsible for ensuring someone is available to receive live shipments.


6. Returns & Refunds (Dry Goods)

For equipment and dry goods:

  • Returns must be requested within 3 days of delivery.

  • Items must be unused and in original packaging.

  • Certain items (e.g., fish food, opened chemicals, medications, custom orders) are non-returnable.

  • Return shipping costs are the responsibility of the customer unless the item is defective.


7. Pricing & Payment

  • Prices are listed in South African Rands (ZAR).

  • We reserve the right to modify prices without notice.

  • We may refuse or cancel any order at our discretion, including suspected fraudulent transactions.


8. Accuracy of Information

We strive for accuracy in product descriptions, stock availability, and pricing, but we do not guarantee that all information is error-free. We reserve the right to correct errors without prior notice.


9. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages arising from product use.

  • Aquarium keeping involves inherent risk, and livestock survival cannot be guaranteed beyond arrival.

  • Our maximum liability shall not exceed the amount paid for the product.


10. User Comments & Reviews

If you submit comments, suggestions, or reviews:

  • You grant us the right to use them for marketing purposes.

  • We may remove content deemed offensive, false, or misleading.


11. Prohibited Uses

You may not use the site:

  • For unlawful purposes

  • To harass, abuse, or discriminate

  • To upload malicious code

  • To infringe upon intellectual property rights
